By accessing or using the Ayisyen Konekte mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Ayisyen Konekte is a community platform that connects users with local events, businesses, radio stations, job opportunities, and other content within the Haitian community worldwide. The App allows users to:

• Discover and share information about events
• Find and connect with local businesses
• Listen to Haitian radio stations
• Post and browse job listings
• Create and interact with community posts
• Subscribe to premium features

3. User Accounts

3.1 Account Creation

• You must create an account to access certain features of the App
• You may sign in using Google Sign-In or Apple Sign-In
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 13 years old to use the App (or the age of majority in your jurisdiction)

3.2 Account Responsibilities

• You are responsible for all activities that occur under your account
• You must provide accurate and complete information when creating your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

4. User-Generated Content

4.1 Content You Post

• You retain ownership of content you post on the App
• By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content within the App
• You are solely responsible for the content you post

4.2 Content Guidelines

You agree NOT to post content that:

• Is illegal, harmful, or violates any laws
• Infringes on intellectual property rights of others
• Contains hate speech, harassment, or discrimination
• Is spam, fraudulent, or misleading
• Contains personal information of others without consent
• Contains explicit or adult content
• Promotes violence or illegal activities

4.3 Content Moderation

• We reserve the right to review, edit, or remove any content at our discretion
• We may suspend or ban users who violate content guidelines
• We are not obligated to monitor all content but may do so

5. Subscriptions and Payments

5.1 Subscription Plans

• The App offers subscription plans with premium features
• Subscription fees are charged through Apple App Store or Google Play Store
• Subscription prices may vary by region and are subject to change

5.2 Subscription Terms

• Subscriptions automatically renew unless cancelled
• You can cancel your subscription at any time through your device's app store settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods

5.3 Premium Features

Premium subscribers receive:

• Featured placement for businesses, events, and radio stations
• Unlimited job postings
• Unlimited feed posts
• Priority support
• Featured badge

5.4 Refunds

• Refund requests must be made through Apple App Store or Google Play Store
• We follow the refund policies of the respective app stores
• Refunds are at our sole discretion for cases outside app store policies

6. Intellectual Property

6.1 Our Rights

• The App, including its design, features, and functionality, is owned by us
• Our trademarks, logos, and brand names are our property
• You may not use our intellectual property without written permission

• You retain ownership of content you create and post
• You grant us a license to use your content as described in Section 4.1

7. Prohibited Activities

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to the App or other users' accounts
• Use automated systems (bots, scrapers) to access the App
• Interfere with or disrupt the App's operation
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App to transmit viruses, malware, or harmful code

8. User Roles and Permissions

8.1 User Roles

The App has different user roles with varying permissions:

• User: Basic access, can create events, businesses, and radios (limited)
• Business Owner: Subscribed users with enhanced features
• VIP: Special users with subscription benefits without payment
• Moderator: Can edit and approve content, cannot delete
• Admin: Full access to all features

8.2 Content Limits

• Free users: Limited to 1 business, 1 radio, unlimited events, no jobs or feed posts
• Subscribed users: Unlimited jobs and feed posts, still limited to 1 business and 1 radio
• All users: Unlimited events

9. Third-Party Services

The App integrates with third-party services including:

• Firebase (authentication, database, storage)
• Google Maps (location services)
• RevenueCat (subscription management)
• Google Sign-In and Apple Sign-In

Your use of these services is subject to their respective terms of service and privacy policies.

10. Disclaimers

10.1 Service Availability

• We do not guarantee that the App will be available at all times
• We may suspend or discontinue the App or any features at any time
• We are not responsible for any downtime or service interruptions

10.2 Content Accuracy

• We do not verify the accuracy of user-generated content
• Users are responsible for the accuracy of information they post
• We are not liable for any errors or omissions in user content

10.3 No Warranty

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Content you post on the App

13. Termination

13.1 By You

• You may stop using the App at any time
• You may delete your account through the App settings

13.2 By Us

We may suspend or terminate your access to the App if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• We are required to do so by law
• We discontinue the App

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date
• Sending a notification (if significant changes)

Your continued use of the App after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:
